Terms and Conditions: |
This
agreement contains the complete terms and conditions that apply in
the NABAZA system in the NABAZA.NET
web site.
Additional terms as used in this agreement: "Buyer" means customer
who places an order through NABAZA.NET
"Vendor" means the site or supplier where the NABAZA.NET
intends to purchase the item.
"Purchase Order" pertains to the valid conforme purchase agreement
between NABAZA.NET and
the buyer.
"Site" means the world wide website.
The NABAZA.NET AGREEMENT
/ BUYING POLICY
To begin the process, a Buyer shall complete a NABAZA.NET
Secure Order Form via the NABAZA.NET
Site. NABAZA.NET shall
evaluate the order application in good faith and will notify the Buyer
including the tracking number assigned by FEDEX.COM
on items ordered online. NABAZA.NET
will update it's digital storefront every two days and will notify
the buyer as soon as it receives the email containing the order of
within 13 hours.
1) NABAZA.NET shall purchase
the item on behalf of the buyer. As soon as the online purchase order
is completed and credit card, check or money order is received, the
order is processed for fulfillment and shipping to the U.S.
2) NABAZA.NET shall submit
a LEAD TIME timetable based on best time delivery time estimates from
the VENDOR TO SHIPPER AND FROM THE SHIPPER TO THE U.S. NABAZA.NET
is not responsible for delays caused by unavailability of product,
missed delivery on the VENDOR's side, and unavoidable CUSTOMS AND
CLEARANCE delays which may happen from time to time.
NABAZA.NET also does not
guarantee or insure products for damage or loss during shipping to
the U.S.
3) NABAZA.NET shall not
be able to reverse or recall an online charge so the BUYER needs to
be sure of the exact quantity and item that he or she is interested
in purchasing. Under no circumstance whatsoever shall NABAZA.NET
be liable for any change or abrupt cancellation.
4) Products that are purchased online shall be subject to warrantees
as guaranteed by the manufacturer. NABAZA.NET
only acts as a purchasing agent and is free from any liability due
to product defect or inherent defect. Should the VENDOR have a returns
policy, the BUYER shall solely shoulder the shipping expenses to get
the product returned.
5) NABAZA.NET does not
insure inbound shipments, should the buyer prefer an insurance policy,
this shall be negotiated with NABAZA.NET
subject to conformity with SHIPPER'S insurance rates. This shall constitute
an additional service charge.
6) Force Majeure. Neither party shall be liable hereunder by reason
of any failure or delay in the performance of its obligation on account
of strikes, shortages, riots, insurrection, fires, flood, storm, earthquakes,
acts of God, war, government action, explosions, labor conditions,
and any other cause which is beyond the reasonable control of such
party.
7) NABAZA.NET shall under
no circumstance purchase on behalf of any buyer ITEMS under the following
categories (including but not limited to the following categories)
: `SEXUALLY EXPLICIT OR ADULT MATERIALS HAZARDOUS MATERIAL AND TOXIC
SUBSTANCES (INCLUDING BUT NOT LIMITED TO) COMPRESSED GASES, CORROSIVES,
EXPLOSIVES, HAND GUNS, AMMUNITION, FIREWORKS, FLAMMABLE MATERIAL LIQUIDS
AND SOLIDS, RADIOACTIVE MATERIALS, OXIDISING MATERIALS, POISONS AND
INFECTIOUS SUBSTANCES AND OTHER DANGEROUS ARTICLES. PROHIBITED DRUGS
LIVE ANIMALS OR PLANTS ANY ITEM WHICH PROMOTES DISCRIMINATION BASED
ON RACE, SEX, RELIGION, `NATIONALITY, DISABILITY, SEXUAL ORIENTATION
OR AGE. VIOLATION OF INTELLECTUAL PROPERTY CERTAIN PROHIBITED ELECTRONIC
ITEMS AUTOMOBILES AND MOTOR VEHICLES
8) NABAZA.NET serves only
as a purchasing service on behalf of a customer. There are items available
online which may not be eligible for purchase due to purchase value
considerations, limitation due to item-type, or non-feasible shipping
considerations, legal prohibitions.
9) QUOTE GOOD FOR 2 DAYS Since most of the products we shall purchase
on your behalf shall be based in U.S. dollars, we can only quote to
you based on a peso dollar conversion rate for a limited period. All
our quotes are good only for 2 days.
10) Upon signing our online secure order form, we shall process your
order within 13 hours upon receipt of payment either in the form of
a check, money order or via your credit cards using VISA, AMEX and
MASTERCARD.
11) In case of delivery delays, we shall inform you of delivery backlogs
or any unforeseen delays.
12) In case of misdeliveries within the U.S. ,where possible we shall
endeavor to countercheck with our shipper in the U.S. and verify that
the correct item was purchased. In case of a misdelivery on the part
of the VENDOR, we shall inform you of the delay and error and advice
you as to the impact on delivery lead time. We shall not be able to
reverse the purchase order but we shall endeavor (on best effort basis)
to secure the exact item which your ordered. any more questions??

13) All prices are in U.S. Dollars and the gifts are delivered only
in U.S. NABAZA.NET does
not guarantee the delivery date specified by the BUYER. NABAZA.NET
will dispatch items within 13 working hours of receiving the order.
If sender specifies a particular delivery date, NABAZA.NET
will postpone the dispatching of the item until such a date that it
reaches around the specified date of the BUYER. In any circumstances,
NABAZA.NET does not guarantee
the exact date of delivery specified by the BUYER. The date of delivery
may vary according to the efficiency of respective couriers by which
the items are dispatched and the remoteness of the BUYER. NABAZA.NET
shall try its best for prompt delivery; delayed/early delivery for
whatever reason shall not entitle the user for any damages or compensation.
14) NABAZA.NET will not
charge more than the prices mentioned on its web pages but in certain
unavoidable circumstances it reserves the right to change the prices
anytime, without any prior notice and charge the sender accordingly.
The digital store front will be updated every 2 days.
In the course of a user using the NABAZA.NET
web site, certain information is automatically tracked. This information
includes the URL that the user just came from, which URL the user
next goes to (whether this URL is on our site or not), which browser
the user is using, and the IP address. Many sites automatically collect
this information.
NABAZA.NET also uses cookies on certain pages of the web site,
as cookies allow users to enter their passwords less frequently during
a session. On the other hand, cookies can also help us provide information
that is targeted towards a user's interest. Cookies are stored in
your hard drive, not on our web site. Most cookies are "session cookies",
meaning that they are automatically deleted at the end of a session.
If a Member sends us personal correspondence, such as emails or letters,
or if other users or third parties send us correspondence concerning
a member's activities, such as inquiries, etc. such information will
be collected and retained in a file specific to the Member.
